ADITYA NARAYAN MAHAJAN

Managing Partner

Aditya is the Managing Partner at Ako Legal. He has more than a decade of experience in representing and advising clients on both domestic and cross border disputes. He has acted for clients in both ad hoc as well as institutional arbitrations. He has represented companies in the construction, energy, infrastructure, power, oil & gas, technology, and telecom sectors, before judicial forums in India as well as before arbitral tribunals.

Besides arbitrations, Aditya has a robust practice before the NCLT, advising banks and financial institutions on various issues. He has initiated many insolvency proceedings and also advised the Committee of Creditors while negotiating with the Resolution Applicants.

He has also advised clients on disputes relating to Copyright and Trademark infringement. Having a keen eye for detail, he has often managed to secure settlements for clients in seemingly unfavourable situations, putting an end to litigation swiftly.

Prior to founding Ako Legal, Aditya was a partner with a major full-service law firm.

Advised GMR Kamalanga Energy Limited on an ad-hoc International Arbitration pertaining to the construction of a Thermal Power Plant involving overall claims of over USD 300 Million.
Represented IL&FS Engineering & Construction Co. Ltd. in an arbitration pertaining to the construction of an irrigation dam.
Represented a pipeline contractor in arbitration proceedings pertaining to the construction of a pipeline in the Mangalore region for strategic storage of crude oil.
Represented IL&FS Engineering & Construction Co. Ltd. in an arbitration against Paschimanchal Vidyut Vitaran Nigam Limited for a rural electrification project.
Represented Om Energy Generation Pvt. Ltd. in an arbitration initiated by Flovel Energy Pvt. Ltd.
Represented BHEL in an arbitration against Simentech (India) Pvt. Ltd. in relation to damages for delay in construction by Simentech. The award has been challenged by Simentech before Delhi High Court which is currently pending.
Represented Kyndryl Solutions Pvt. Ltd. in a proceeding for appointment of arbitral tribunal under section 11 of the A&C Act before Gujarat High Court.

Insolvency and Bankruptcy:

Advised Axis Bank Ltd. for initiation of Insolvency proceedings and eventually the Committee of Creditors in the successful resolution of Prius Commercial Projects Pvt. Ltd. and other group companies.
Represented Axis Bank in NCLT, New Delhi against an application of the Resolution Professional of Era Infra Engineering Limited for consolidation of resolution process of all its group companies.
Represented Maharashtra State Power Generation Co. Ltd. before NCLT, Delhi in an application filed by the of Liquidator of Tecpro Systems Ltd. for seeking refund of certain bank guarantees encashed.
Represented Axis Bank Ltd. before NCLT, Delhi on initiation of CIRP proceedings against Eurotas Industries Ltd. and also advised the CoC on the Liquidation Application and the appointment of a different Liquidator in place of the Resolution Professional.
Represented Greenergy Wind Energy Corporation Pvt. Ltd. before NCLT, Hyderabad seeking permission to participate in the CIRP of Lanco Hoskote Highway Limited.
Represented Axis Bank Ltd. before NCLT, Allahabad in the initiation of CIRP against Lanco Mandakini Hydro Energy Private Limited.
Represented CFM Asset Reconstruction Pvt. Ltd. in petitions against personal guarantors before NCLT, Delhi.

Represented Musicmuni Labs Pvt. Ltd. in a suit for infringement of copyright initiated by Saregama India Ltd.
Represented Access Design Pvt. Ltd. in a suit for infringement of copyright in a software called ‘Catia’ by Dassault Systemes S.E.
Advised Focally Pvt. Ltd. in a dispute for infringement of one of the softwares of Dassault Systemes S.E.
Represented Calderys India Refractories Ltd. in a trademark infringement suit against various defendants in relation to the infringement of trademark ‘Hysil’.
